Se revocó la providencia de la Sala Civil-Laboral del Tribunal Superior de Distrito Judicial de Popayán por medio de la cual decidió inhibirse por falta de competencia para resolver el proceso instaurado por el actor de la referencia, toda vez cuando el juez se declara competente inicialmente para conocer de la pretensión de tutela no puede luego abstenerse de decidir so pretexto de la falta de competencia, pues esto atenta contra la prohibición contenida en el parágrafo del Art. 29 del Decreto 2591.

Por lo expuesto anteriormente, la Corte ordenó remitir de nuevo el expediente a la mencionada Sala para que tramitara como corresponde la petición de tutela del actor.

  1. PRIMERO. REVOCAR la providencia de la Sala Civil-Laboral del Tribunal Superior de Distrito Judicial de Popayan del dieciseis (16) de noviembre de mil novecientos noventa y cinco (1995), por medio de la cual decidio inhibirse por falta de competencia para resolver la accion de tutela instaurada por el senor Gilberto Narvaez Narvaez.
  2. SEGUNDO. ORDENAR que por la Secretaria General se remita el expediente contentivo del proceso No. T- 54957 a la Sala Civil-Laboral del Tribunal Superior de Distrito Judicial de Popayan para que se tramite como corresponde, segun la Constitucion y la ley, la peticion de tutela del actor.
